RevCheck provides a document revision management platform that enables users to:

• Upload and manage documents and their revisions
• Generate QR codes for document tracking
• Track document scans and analytics
• Share documents with controlled access
• Organize documents in projects and folders

• Be responsible for all taxes

8. COMPLETE LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REVCHECK, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
• ANY BUGS, VIRUSES, TROJAN HORSES, OR SIMILAR THAT MAY BE TRANSMITTED THROUGH THE SERVICE
• ANY ERRORS, OMISSIONS, OR INACCURACIES IN ANY CONTENT
• ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE
• ANY LOSS OF YOUR DATA OR CONTENT FROM THE SERVICE
• ANY SERVICE INTERRUPTIONS, INCLUDING SYSTEM FAILURES OR OTHER INTERRUPTIONS
• ANY DAMAGES ARISING FROM SECURITY BREACHES, HACKING, DATA THEFT, OR OTHER UNAUTHORIZED ACCESS
• ANY DAMAGES ARISING FROM THE ACTIONS OR INACTIONS OF ANY THIRD PARTIES

THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF REVCHECK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL REVCHECK'S CUMULATIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. COMPLETE DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND.

• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS
• WARRANTIES THAT THE SERVICE WILL BE SECURE OR THAT YOUR INFORMATION WILL BE SECURE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT
• WARRANTIES THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED
• WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS

YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICE AND ANY LINKED SITES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

10. ASSUMPTION OF RISK

YOU ACKNOWLEDGE AND AGREE THAT:

• THE SERVICE MAY CONTAIN BUGS, ERRORS, AND OTHER PROBLEMS
• THE SERVICE MAY BE SUBJECT TO ATTACKS BY HACKERS OR OTHER MALICIOUS ACTORS
• YOUR DATA MAY BE LOST, CORRUPTED, OR BECOME INACCESSIBLE
• THE SERVICE MAY BECOME UNAVAILABLE AT ANY TIME WITHOUT NOTICE
• YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING BACKUPS OF YOUR DATA
• YOU USE THE SERVICE AT YOUR OWN RISK AND DISCRETION

11. COMPLETE INDEMNIFICATION

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD COMPLETELY HARMLESS REVCHECK, ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS, AND ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SUPPLIERS, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBT, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including intellectual property rights
• Your violation of any applicable law, rule, or regulation
• Any claim or damage arising from content you submit, post, or transmit through the Service
• Your willful misconduct, fraud, or negligence
• Any unauthorized use of your account
• Any security breach resulting from your actions or omissions

This indemnification obligation will survive the termination of these Terms and your use of the Service.
